Fabled Paws operates this store and website, including all related information, content, features, tools, products, and services in order to provide you, the customer, with a curated shopping and creative design experience (the "Services"). Fabled Paws is hosted and powered by Shopify, which enables us to provide the Services to you.
The below terms and conditions, together with any policies referenced herein (these “Terms of Service” or “Terms”) describe your rights and responsibilities when you use the Services. Please read these Terms of Service carefully, as they include important information about your legal rights and cover areas such as warranty disclaimers and limitations of liability.
By visiting, interacting with, or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these Terms of Service or Privacy Policy, you should not use or access our Services.
SECTION 1 - ACCESS AND ACCOUNT
By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence. You are solely responsible for maintaining the security of your account credentials and for all of your account activity. You represent and warrant that all information you provide is correct, current, and complete.
SECTION 2 - OUR PRODUCTS, AI DISCLAIMER, AND CREATOR STUDIO POLICY
We have made every effort to provide an accurate representation of our products. However, colors or product appearance may differ based on your device settings.
High-Definition Digital Upscaling Pipeline & Verification Disclaimer
Our Services utilize advanced Artificial Intelligence (AI) and professional image rendering systems to generate custom artwork based on the photos you upload. By using our Services, you acknowledge that:
- Digital Interpretations: The artwork is a digital impressionist or stylistic interpretation, not a photorealistic replica.
- Outfit Adaptation: Outfits shown on our site serve as stylistic inspiration. The digital system custom-tailors the clothing to naturally fit your pet's body shape, meaning exact placement, angles, and folds may vary from the reference image.
- Inherent Artifacts: AI generation may occasionally produce minor artifacts or spatial blending. These are inherent characteristics of neural rendering and are not considered defects.
- High-Definition Upgrades (4K or 8K): Upgrading to a 4K High-Definition or 8K Gallery Masterpiece (Digital or Physical Canvas) involves our professional 4K/8K Digital Upscaling Pipeline and quality assurance review. This process reconstructs high-fidelity details (such as refined fur texture, background lighting, and canvas contrast) to ensure optimal print quality, which may cause the final high-resolution file to slightly differ from the initial lower-resolution preview.
- No Guarantee of Likeness: We do not warrant that the final aesthetic resemblance will meet your subjective personal expectations.
- Non-Refundable Custom Goods: Due to the highly customized, computational nature of these goods, dissatisfaction with the final artistic style, outfit adaptation, or digital upscaling refinements (including 4K and 8K upscaling) does not constitute grounds for a refund.
- Physical Cropping & Aspect Ratios: Previews are generated in a standard 2:3 aspect ratio. Depending on the physical canvas size selected (such as 8"x10" or 12"x16"), the final artwork will be expertly center-cropped to perfectly fit the frame dimensions. Minor loss of background or edge details due to this necessary cropping is expected and does not constitute a defect or grounds for a refund.
Premium Creator Credits & Fair Use Policy
If you purchase a Creator Pass or receive bonus credits, these Premium Creator Credits are non-transferable, have no cash value, and are solely valid for generating assets within our interactive Creator Studio. We reserve the right to modify credit pricing, expiration, or Studio features. To ensure optimal performance, "Unlimited" access tiers (if applicable) are subject to our Fair Use Policy. We reserve the right to limit AI generation requests to a reasonable maximum (currently 100 generations per 24-hour period) to prevent automated abuse. Additionally, Fabled Paws enforces strict content moderation. Any attempt to upload or generate content involving animal cruelty, violence, explicit nudity, or hate speech is strictly prohibited. We reserve the right to block such requests, suspend your Creator Credits without refund, and terminate your account immediately.
SECTION 3 - ORDERS
Fabled Paws LLC reserves the right to accept or decline your order for any reason. Your order is not accepted until confirmed via email. Purchases are subject to return or exchange solely in accordance with our Refund Policy.
SECTION 4 - PRICES AND BILLING
Prices are subject to change without notice. You agree to provide current, complete, and accurate purchase and account information. You represent and warrant that you are authorized to use the provided payment method.
SECTION 5 - SHIPPING AND DELIVERY
All delivery times are estimates only and are not guaranteed. We are not liable for shipping delays. Once we transfer physical products to the carrier, title and risk of loss passes to you.
SECTION 6 - INTELLECTUAL PROPERTY
Our Services, including logos, text, and images, are owned by Fabled Paws LLC and protected by intellectual property laws. These Terms permit personal, non-commercial use only.
User Submitted Photos & Generated Artwork
By uploading User Content, you represent and warrant that you own or have the necessary rights, licenses, and permissions to use and authorize Fabled Paws LLC to use the photos you submit. You grant Fabled Paws LLC a worldwide, royalty-free, perpetual license to use, modify, and process your submitted photos to fulfill your order. Furthermore, you grant Fabled Paws LLC the right to use, publish, and display the final AI-generated artwork (excluding your original source photos) in our public digital galleries, portfolios, social media channels, and marketing materials. Unless otherwise agreed, the final AI-generated artwork remains the intellectual property of Fabled Paws LLC, licensed to you for personal, non-commercial use only (such as personal printing, gifting, and social media posting).
SECTION 7 - COPYRIGHT INFRINGEMENT & DMCA POLICY
Fabled Paws LLC respects the intellectual property rights of others. If you believe that your copyrighted work has been copied or used on our Services in a way that constitutes copyright infringement, please notify us immediately at support@fabledpaws.com with a detailed written notice compliant with the Digital Millennium Copyright Act (DMCA). Upon receipt of a valid notice, we will promptly remove or disable access to the allegedly infringing material and may terminate the accounts of repeat infringers.
SECTION 8 - THIRD-PARTY TOOLS & LINKS
We may provide access to optional third-party tools (e.g., payment gateways) "as is" without warranties. We are not responsible for the content or accuracy of third-party websites accessed through our Services.
SECTION 9 - PRIVACY POLICY
Personal information collected is subject to our Privacy Policy. Since our Services are hosted by Shopify, certain transactional data is also subject to Shopify’s Privacy Policy.
SECTION 10 - FEEDBACK
By submitting feedback or suggestions, you grant us a perpetual, worldwide license to use it for any purpose, including commercial use. We have no obligation to maintain feedback in confidence or pay compensation.
SECTION 11 - PROHIBITED USES
In addition to other prohibitions as set forth in the Terms of Service, you are prohibited from using the site or its content:
- (a) for any unlawful purpose or to solicit others to perform or participate in any unlawful acts;
- (b) to use any robot, spider, scraper, data mining tool, or other automated means to access, copy, or extract data, images, or text from our Gallery or Services;
- (c) to download or use our images, text, or website data to train, fine-tune, or develop any machine learning or artificial intelligence models;
- (d) to infringe upon or violate our intellectual property rights or the intellectual property rights of others;
- (e) to upload or transmit viruses or any other type of malicious code.
We reserve the right to terminate your access or use of the Services for any prohibited use.
SECTION 12 - DISCLAIMER OF WARRANTIES & LIMITATION OF LIABILITY
THE SERVICES AND PRODUCTS ARE PROVIDED 'AS IS' WITHOUT ANY WARRANTIES. IN NO CASE SHALL Fabled Paws LLC BE LIABLE FOR ANY INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE SERVICES.
SECTION 13 - INDEMNIFICATION
You agree to indemnify, defend and hold harmless Fabled Paws LLC and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party (including intellectual property infringement related to the photos you upload).
SECTION 14 - SEVERABILITY
In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.
SECTION 15 - GOVERNING LAW
These Terms of Service and any separate agreements shall be governed by and construed in accordance with the laws of the State of Wyoming, United States, without regard to principles of conflicts of law.
